This Terms of Service agreement ("Agreement") is a legally binding contract between you ("User" or "you") and Bondware, Inc. dba PoserSoftware.com (PoserSoftware), a Tennessee corporation ("Company," "we," "us," or "our"). By accessing or using the PoserSoftware.com website and any related services, you agree to be bound by the terms and conditions set forth in this Agreement.

1. Acceptance of Terms
By accessing or using our website, you agree to be bound by these Terms of Service and our Privacy Policy, which is incorporated by reference. If you do not agree with these terms, you should not use our website.

2. Description of Services
PoserSoftware provides an online platform that allows users to learn about the Poser 3D Art and Animation software, download the software and purchase licenses and content for use within Poser.  Also, Users may engage in discussions, create user-generated content, etc.. The platform may also include additional features such as galleries, forums and user ratings.

3. User Registration
3.1. To access certain features of the platform, you may be required to register an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.
3.2. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to immediately notify us of any unauthorized use of your account or any other breach of security.

4. User Conduct
4.1. You agree to use our platform in accordance with all applicable laws and regulations.
4.2. You may not:

a. Post, transmit, or otherwise make available any content that is illegal, offensive, or infringing upon the rights of others
b. Harass, threaten, or engage in any harmful conduct toward other users, or

5.1. All content on our platform, including text, graphics, logos, and user-generated content, is protected by intellectual property rights owned by PoserSoftware or its licensors.
5.2. By posting content on our platform, you grant PoserSoftware a non-exclusive, transferable, sub-licensable, royalty-free, worldwide license to use, display, and reproduce that content in connection with our services.

6. Refunds
We offer a satisfaction-guaranteed policy on purchase of software licenses on the website for a period of 30 days after purchase.  The Purchaser can request a refund by providing the order number at at https://support.posersoftware.com.  The purchase amount will be refunded and the license will be deactivated.
For downloadable content, we provide refunds after download only in the case where the Purchaser reports a material defect in the product.

7. Termination
We reserve the right to terminate or suspend your account and access to our platform for any reason, without notice.

Purchasers who charge-back or dispute payment on orders containing content items which have been downloaded since purchase and where there is no material defect in the item will result in termination (permanent ban of the user) from this site and other Bondware-owned sites.
 
8. Disclaimers and Limitation of Liability
8.1 Our platform is provided on an "as-is" and "as available" basis. We make no warranties or representations about the accuracy or completeness of the content provided on our platform.
8.2. To the extent permitted by law, we shall not be liable for any indirect, consequential, special, or punitive damages.

9. Governing Law and Dispute Resolution
This Agreement is governed by the laws of Tennessee. Any legal disputes arising from or related to this Agreement will be resolved in accordance with the courts in Murfreesboro, TN.

10. Changes to the Terms of Service
We reserve the right to modify or update these Terms of Service at any time. Your continued use of our platform following the posting of any changes constitutes acceptance of those changes.
